These Terms of Service (“Terms”) govern your use of this website, operated by Whitaker for Mayor (the “Committee,” “we,” “us”). By using this site, joining our lists, or making a contribution, you agree to these Terms. If you do not agree, please do not use the site.
1. Use of the site
You may use this site only for lawful purposes. You agree not to interfere with the site’s operation, attempt to gain unauthorized access to any systems, scrape or harvest supporter information, submit false information through our forms, or use the site to send spam or malicious content.
2. SMS program terms — “Whitaker for Mayor Campaign Updates”
Program description
The Whitaker for Mayor Campaign Updates program sends recurring campaign news, event alerts, volunteer opportunities, and donation requests by automated text message (SMS/MMS) and calls to supporters who have provided express written consent.
Opting in
You opt in by checking the consent box on our signup form and providing your mobile number (or by texting a posted keyword where offered). Consent is not a condition of any purchase or donation. You must be 18 years of age or older and the account holder (or have the account holder’s permission) for the mobile number provided. The program is available to United States numbers only.
Message frequency, rates, and delivery
Message frequency varies based on campaign activity. Message and data rates may apply according to your mobile plan. Carriers are not liable for delayed or undelivered messages. Delivery is subject to the availability and effective transmission of your mobile operator’s network.
Opting out and help
Reply STOP to any message to cancel and stop receiving texts from the program; you may receive one final message confirming your opt-out. Reply HELP to any message for assistance, or contact us at the mailing address below.
Your data
We will not share or sell your mobile opt-in data or consent with any third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. See our Privacy Policy for full details on how supporter information is handled.
3. Donation terms
Contributions to Whitaker for Mayor are processed by a third-party payment processor on the processor’s own secure pages; your payment details are handled by the processor, not stored by this website. By contributing, you confirm that the following statements are true and accurate:
- This contribution is made from your own funds, and funds are not being provided to you by another person or entity for the purpose of making this contribution;
- You are making this contribution with your own personal credit or debit card and not with a corporate or business card or a card issued to another person;
- You are at least 18 years old;
- You are a United States citizen or a lawfully admitted permanent resident;
- You are not a federal government contractor, where applicable law prohibits contributions from federal contractors.
Contributions are not tax deductible as charitable contributions. Contribution limits and disclosure requirements for municipal races are set by state and local law; the Committee complies with the campaign-finance rules of its jurisdiction, including collecting and reporting contributor information where required. If a contribution exceeds an applicable limit or is otherwise impermissible, it will be refunded or reattributed as the law allows. Recurring contributions may be canceled at any time by contacting the Committee at the address below.
4. Intellectual property
The content of this site — text, graphics, logos, the campaign seal, and page design — belongs to the Committee or its licensors and is protected by applicable intellectual-property law. You may share campaign materials for personal, non-commercial purposes that support ordinary civic participation; any other reproduction or use requires our written permission.
5. Third-party links and services
The site may link to third-party services (such as our payment processor or social platforms). Those services have their own terms and privacy practices, which we do not control and for which we are not responsible.
6. Disclaimer and limitation of liability
This website and its content are provided “as is” without warranties of any kind, express or implied, including warranties of accuracy, availability, or fitness for a particular purpose. To the fullest extent permitted by law, the Committee will not be liable for indirect, incidental, or consequential damages arising from your use of the site. Nothing on this site is legal, tax, or financial advice.
7. Changes to these Terms
We may revise these Terms from time to time. The “Last updated” date above reflects the current version, and continued use of the site after changes are posted constitutes acceptance of the revised Terms.
